1. General Remarks for Terms and Conditions
These terms and conditions apply to all purchase and usage of all services as well as all deliveries from shampoo.ch GmbH. By placing an order, the customer agrees with these terms and conditions. These terms and conditions cover all deliveries of products and services purchased in the online shop www.shampoo.ch of shampoo.ch GmbH (henceforth referred to as shampoo.ch). The offered products and services are only available for the selected countries.
2. Offering / Prices
All offers from shampoo.ch are without engagement and non-binding. Subject to change prices or the range of products as well as mistakes are without prior notice. Packshots/ pictures or products can differ in colour and design form the original. Descriptions of products can vary in content, chemically and technically from the descriptions of the manufacturer. From the time when an order is placed, prices are binding. To see the current prices, visit www.shampoo.ch. All prices are in Swiss Francs and include VAT (value added tax). In case of a mistake of the pricing, shampoo.ch reserves the right to change prices after the order was placed. In such a case, shampoo.ch will inform the customer as soon as possible and the customer can step back from the purchase of the particular product.
The contract will come off as soon as the customer accepts the order at the end of the ordering process after choosing his or her payment method, which is either by bill, by credit card, by postcard, PayPal or prepayment. Placing an order is binding and will be confirmed with an E-Mail to the given e-mail address of the customer. shampoo.ch reserves the right to decline any orders from any customer. The customer is responsible for the completeness and correctness of the entered invoice and delivery address. If there is incorrect information, shampoo.ch reserves the right to decline an order. Products which are not available from stock have to be ordered from the manufacturer or distributor. If so, a contract will only come off as long as shampoo.ch is being delivered with the particular product. If a product is no longer manufactured or cannot be delivered by our partners, a contract will not come off. An annulment of the ordered products is only possible with an agreement from shampoo.ch. By placing an order, the purchaser confirms that he is at least 18 years of age.
shampoo.ch owns a large stock of all products which are acquirable on the online shop. Products in stock will be normally packaged and mailed on the current or the following day of the order. Therefore, a customer will receive his order within 1 to 4 days. Products which are not available from stock have to be ordered from the manufacturer or distributor. Consequently the delivery can be delayed. In no case, delays in delivery justify a claim for indemnity or a right of withdrawal. Delivery time and dates are non-binding. Right after receiving the package the customer must check it for completeness. False deliveries have to be reported to shampoo.ch within 5 days. Otherwise, shampoo.ch reserves the right to charge additionally delivered products. If shampoo.ch delivers for account of the customer with a payment slip, the delivered products will be property of shampoo.ch until the owed amount of money is paid.
The customer accepts the delivery of the order by Swiss Post as a simple parcel post. A shipment is deemed to have been delivered to the customer when the Swiss Post has handed over the package to the recipient or has delivered it to another designated location (for example, a letterbox or a filing box). The customer acknowledges the delivery events recorded electronically by the Swiss Post as proof of the effected deliveries.
By handing over the parcel to Swiss Post, shampoo.ch has fulfilled its delivery obligations and thus has duly fulfilled the contract. A liability of shampoo.ch is excluded for a loss of the package during transport, damage, loss or delay in delivery if shampoo.ch has placed the goods on time and properly packed. Incidentally, the “General Terms and Conditions for private customers” of Swiss Post apply."
5. Delivery quantity
shampoo.ch reserves the right to limit the delivery quantity for specific products or to not delivery a specific product. If there is an unpaid invoice of a customer or a person who lives in the same address, shampoo.ch reserves the right to decline orders or hold them back until the unpaid invoice is paid.
6. Shipping Costs
Shampoo.ch sends all deliveries through the Swiss Post. The shipping costs are free of charge for B-Post and CHF 6.- for A-Post. For the addition "Signature" additional CHF 2.- are charged. For "Saturdays delivery" CHF 9 .-. For orders with a value under CHF 25.-, an extra charge of CHF 5.- will be charged. If the customer refuses to accept a delivery and wishes to withdraw from the purchase contract, shipping costs and conversions of CHF 20.- to CHF 30.- will be charged. If a delivery is returned and will be sent again, additional shipping costs of CHF 10.- to CHF 20.- will be charged. If the complete delivery is returned and the customer wants to withdraw from the purchase contract, the customer still has to pay for shipping costs and conversions in the amount of CHF 10.- to CHF 20.-.
If a customer wants to return the delivered products, an application has to be carried out within 5 days after receipt. Returned deliveries or products without the acceptance of shampoo.ch can be declined. In case of an acceptance, shampoo.ch will inform the customer in written form or with an e-mail. Returned products will only be accepted in their original packing.
Complaints regarding the quality of delivery or products will only be accepted within 5 days after receipt.
In general, the warranty which is enclosed with the specific product is valid. Warranty is only extended to the direct buyer of the product and is not transferable. Repaired or altered products caused by the customer are excluded of any warranty. shampoo.ch decides how a warranty takes place.
10. Invoicing / delayed payments
Invoices will be sent to the given address after or with the delivery of the ordered products. Invoices must be fully paid within 10 days without any reduction or discount. Unauthorized reductions will be charged subsequently. If the invoice has not been paid in due time, a first payment reminder will be sent for free. The second payment reminder will be sent with an additional service charge of CHF 10. If the invoice is not paid in due time repeatedly, a menace of enforcement with interests on arrears of 5% and a total dunning charge of CHF 20.- will be sent to you.
If the menace of enforcement is not being paid within 10 days after transmission, the bill will be transferred to our dept collection partner Intrum Justitia and the following costs will be due:
a) Dunning fee of CHF 30 40/60 days after the billing date
b) Service charge depending on the due amount on CHF 30 (to 100) 60 (to 200) 90 (to 300) 120 (to 400) 150 (to 500) 180 (to 1‘000) 280 (to 2‘000) 380 (to 4‘000); 10% of the due amount (from 4‘000 upwards)
11. Damage during transport
Any possible transport damage has to be reported to the Swiss Post immediately. shampoo.ch reserves the right to decline any transport damages which are not proven by a damage report. Transport damages have to be reported within 5 days.
New customers who order products worth more than CHF 500 (including shipping costs) have to pay per credit card (PayPal). Orders below CHF 500 or orders of regular customers can be paid for their account by a payment slip. shampoo.ch reserves the right to decide who will become a regular customer. shampoo.ch also reserves the right to check orders for their credit-worthiness. shampoo.ch uses ensured systems to transfer data, especially credit card numbers are ciphered via SSL technology.
shampoo.ch assures to treat all personal customer data confidential and not to pass them on to third parties. In the context of ordinary business data can passed on to business partners. Customers can change their personal data under ‘my account’.
shampoo.ch cannot be held liable for damages or subsequent damage caused by the products sold by shampoo.ch. In particular, damages based on usage of the product, error of performance or loss of production as well as not being able to deliver, breach of contract or errors in contract fulfilments are not valid against shampoo.ch.
15. Law / Court
The contract is solely governed by Swiss Law. Court of jurisdiction is Zurich, Switzerland.
16. Changes in Terms and Conditions
If sections or individual terms of this terms and conditions are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact. shampoo.ch reserves the right to change these terms and conditions anytime and apply them immediately.
shampoo.ch reserves the right not to be responsible for the topicality, correctness, completeness or quality of the descriptions and information provided. Warranty claims regarding tangible or intangible damage or consequential damage caused by the use of any information provided, including any kind of information which is incomplete or incorrect, will therefore be rejected. Parts of the pages or the complete publication including all offers and information might be extended, changed or partly or completely deleted by shampoo.ch without particular announcement.

These content and links are provided solely for customer friendliness and information. shampoo.ch is not liable for any third party content or websites, especially the correctness, completeness, quality or timeliness of these websites.
